This Privacy Policy explains how JPK & M Enterprises LLC (“BlackwellOS,” “we,” “us,” or “our”) collects, uses, and shares information when you use our websites, applications, and services (the “Services”).

1) Important Notice: No PHI / No Patient Data
BlackwellOS is a marketing platform and is not intended for storing, processing, or managing protected health information (“PHI”) or patient medical records.
Do not upload, enter, or submit PHI into the Services — including in prompts, documents, transcripts, uploads, edits, templates, or any other content. The Services are designed for marketing and business content only.
If you submit PHI despite this restriction, you do so at your own risk and remain responsible for the content you provide. If you believe you have submitted PHI, contact us at notices@blackwellos.com and we will take reasonable steps to help you remove it from the Services.
2) Information We Collect
We collect information in three ways: (A) information you provide, (B) information collected automatically, and (C) information from integrations/third parties.
A) Information You Provide
- Account information: name, email address, password (stored securely via our authentication provider), organization/practice name, and similar account details.
- Customer Content: content you create, upload, or enter into the Services, such as marketing copy, prompts/instructions, brand details, documents, templates, and AI-generated outputs. Customer Content may include any text or files you choose to enter into the Services; however, you must not submit PHI or patient medical information.
- Support communications: messages and attachments you send to customer support.
B) Information We Collect Automatically
- Usage and device data: IP address, device identifiers, browser type, operating system, app usage events, pages/screens viewed, timestamps, and referring URLs.
- Log and diagnostics data: performance metrics, error logs, and troubleshooting data.
- Security data: information used to help detect fraud, abuse, and unauthorized access.
C) Information from Integrations / Third Parties
Depending on what you connect or use, we may receive or process:
- Payments (Stripe): billing contact details, payment status, invoices/receipts, and limited payment metadata. We do not store full card numbers; Stripe handles payment card processing.
- SEO/SERP data (DataForSEO): search queries you submit and the SERP results returned.
- Stock images (Pexels): image search terms you submit and image URLs/metadata returned.
- Website lead capture (HubSpot): contact details submitted through forms on our marketing website (e.g., name, email, message).
- AI providers (OpenAI/ChatGPT, Google/Gemini, Anthropic/Claude): prompts/inputs you submit to AI features and AI outputs returned, processed to provide the requested functionality.
3) How We Use Information
We use information to:
- Provide, maintain, and secure the Services (account creation, authentication, access control).
- Generate requested outputs and features (including AI-generated marketing content).
- Process payments, subscriptions, and invoicing (via Stripe).
- Perform SEO and SERP research features (via DataForSEO).
- Provide stock images and media features (via Pexels).
- Provide customer support and respond to inquiries.
- Monitor performance, debug issues, and improve reliability and user experience.
- Prevent fraud, abuse, and unauthorized access.
- Comply with legal obligations and enforce our terms.
4) AI Features and Automated Processing
When you use AI features, the inputs you provide (such as prompts, instructions, and text you paste into the tool) and the resulting outputs may be processed by third-party AI providers (including OpenAI, Google (Gemini), and Anthropic) solely to provide the requested functionality.
No PHI reminder: You must not submit PHI to AI features or anywhere in the Services.
Training: We do not use Customer Content to train generalized AI/foundation models. Where available under applicable provider terms and settings, we also configure or contract with providers to process Customer Content to deliver the Services and not to train their generalized models.
5) How We Share Information
We may share information in the following circumstances:
A) Service Providers (Subprocessors)
We share information with vendors who help operate the Services, such as:
- Stripe (payments and billing)
- DataForSEO (SERP/SEO results)
- Pexels (image search and retrieval)
- HubSpot (marketing site lead capture)
- AI providers: OpenAI/ChatGPT, Google/Gemini, Anthropic/Claude (AI processing)
- Hosting / database infrastructure: Supabase (and platform infrastructure provided via Lovable)
These providers process information on our behalf to provide their services to us.
B) Legal, Safety, and Compliance
We may disclose information if we believe disclosure is necessary to:
- comply with law, legal process, or governmental requests;
- enforce our agreements and policies; or
- protect the rights, safety, and security of BlackwellOS, our users, or others.
C) Business Transfers
If we are involved in a merger, acquisition, financing, reorganization, bankruptcy, or sale of assets, information may be transferred as part of that transaction.
D) With Your Consent
We may share information when you direct us to, or otherwise consent.
6) Data Retention
We retain information only as long as reasonably necessary to provide the Services and for legitimate business purposes, such as security, compliance, dispute resolution, and enforcing agreements.
Examples:
- Account information is retained while your account is active.
- Billing records are retained as required by applicable tax and accounting laws.
- Usage and security logs are retained for a limited period to maintain service integrity and prevent abuse.
- Customer Content is retained until you delete it or your account is closed, subject to reasonable backup and operational retention periods.

7) Security
We use reasonable administrative, technical, and organizational measures designed to protect information. No method of transmission or storage is 100% secure, and we cannot guarantee absolute security.
8) Cookies and Tracking
We may use cookies and similar technologies to operate our website, remember preferences, understand usage, and improve performance. You can control cookies through your browser settings and, where applicable, consent tools on our website.
9) Your Choices and Rights
Depending on where you live, you may have rights to access, correct, or delete certain information, and to opt out of certain marketing communications.

The Services are not directed to children, and we do not knowingly collect personal information from children under 13.
11) International Users
If you access the Services from outside the United States, your information may be processed in the United States and other locations where our service providers operate.

We may update this Privacy Policy from time to time. If we make material changes, we will update the “Last Updated” date and may provide additional notice as required.
